A former President of the Court of Appeal, Isa Ayo Salami, has argued that Peter Obi should not have contested the 2023 presidential election under the Labour Party Nigeria.

Salami Flags Alleged Legal Gaps

Speaking in Ilorin, Kwara State, Salami said gaps in judicial competence contributed to controversial rulings that allowed certain candidacies. He maintained that Obi’s emergence as a candidate raised constitutional questions.

According to him, the Labour Party had already submitted its membership register to the Independent National Electoral Commission before Obi joined the party.

“The Constitution does not recognise independent candidacy. So how did he become a candidate if he was not on the party’s register?” Salami queried.

Kano Case Also Cited

The retired jurist also referenced the case of Kano State Governor, Abba Yusuf, noting that similar issues arose regarding party membership records.

He argued that inconsistencies between party registers and issued membership cards highlight deeper problems within Nigeria’s legal and electoral systems.

Concerns Over Judicial Quality

Furthermore, Salami expressed worry about declining standards within the judiciary. He said some judges lack the depth and experience required for the bench, which can lead to flawed decisions.

“Some appointees do not have the proper background. That affects the quality of judgments,” he said.

He added that promotions within the judiciary sometimes prioritise regional considerations over merit, allowing less experienced judges to rise ahead of more qualified colleagues.

Remarks at Award Presentation

Salami made these comments while receiving an award from the Wole Soyinka Centre for Investigative Journalism. The honour was presented by its founder, Dapo Olorunyomi, and Executive Director, Motunrayo Alaka.

He welcomed the recognition and praised the organisation for promoting accountability and excellence in public life.

Influence of Legal Icons

Reflecting on his career, Salami credited renowned playwright Wole Soyinka for shaping his principled stance on national issues.

He also revealed that Nigeria’s former leader, Obafemi Awolowo, inspired his decision to study law after observing his courtroom defence during a historic trial.
